Epic Fail: Hotel Blames Victim For Rape

A Marriott hotel in Connecticut says a woman who was raped there back in 2006, at gunpoint and in front of her children was careless and negligent.

The Stamford Marriott Hotel & Spa filed court papers claiming the woman "failed to exercise due care for her own safety and the safety of her children and proper use of her senses and facilities."

The woman was approached by the rapist at gunpoint. She told him to go through her wallet and take it. But he raped her instead, assaulting the woman in the hotel's parking garage, inside her minivan while her 3 and 5 year old watched. The man reportedly also threatened to assault one of her children. He was arrested three days after the attack and is now serving 20 years.

The woman claims the man was in the hotel and the garage acting suspicious for days before the attack, but the hotel did not notice him or make him leave. The woman has since filed a civil suit against the hotel on grounds it failed to prevent the rape.

Her attorneys say the hotel has revealed her identity by asking her acquaintances, and even a Pilates instructor, to testify.

Where is the justice?

All I can say is wow! I really hate to hear stories like this. It just me angry at how thoughtless and inconsiderate companies can be. Marriott is acting like the woman who was victimized was the one at fault. If she reported the suspicious person and they failed to do anything, they are clearly at fault.

Something's fishy. We are not getting the whole story. How did this lady even know the man had been lurking around for days? I don't think that just because it happened in someone's parking lot that it makes them liable for the rape. You've really got to show that they had notice of the likelihood for crime and that despite the knowledge, they failed to do anything about it. I'm thinking the press is making this look worse than it really is. And come on -- the person responsible for the rape is the rapist.

Traci's right about one thing at least. The rapist is responsible for the rape. Not the victim. The hotel may have some responsibility- if the man was indeed acting suspiciously and hotel employees failed to act. But it is definitely not the woman's fault. Whether we can assign liability to the hotel for failing to keep the garage safe, I don't know. But putting the blame on the woman is offensive and wrong. The response should have been that they are not responsible for the actions of a criminal, feel horrible about what the woman went through, take the safety of their customers very seriously, etc. We need more information before deciding if her lawsuit has merit, but their response definitely does not.

The hotel has responsiblity for the actions of we ever is on the property. I know I currently work at a hotel.The Marriott's employees should of done something when they noticed the male being suspicious. Marriott is WAY,WAY WRONG for putting blame on the victim.I am outraged at their actions.I am at no way or time ever going to staying at a Marriott ever.

I will NOT stay at any Marriott again and I am passing this story along to friends who also have stayed at the Marriott AND friends who may have in the future. Marriott should be ashamed for even trying to get out of this! The Marriott should have just apologized, fixed the problem with more security and payed the lady. The end. That's good business. Caring about your customer. Good publicity is better than this and I will do my best to get this out...

You also should be ashamed for putting the blame on her. Places of business DO have a responsibility to protect their patrons to the best of their ability. As a former business owner and former rape victim, Marriott has to pay for liability insurance for their guests the same as any business owner or home owner for that matter. If something happens to one of their guests while on their premises they are responsible. It is ludicris for them to place blame on their guest. Furthermore no woman in her right mind wants to be raped let alone in front of her young helpless children. This will affect her and her children for the rest of their lives. It doesn't just go away. Shame on Marriott and any other uncaring human being for trying to blame the victim. That said, always be aware of your suroundings and who is there with you. There are just too many sick uncaring selfish individuals who don't care how something is going to affect another human being, they are only out for their own satisfaction.

Shocking, irritating, and whatever other emotions a story like this generates, BUT I'd like to know the victims manner of dress. Some moms are knockouts even after having given birth to multiple offsprings. Was she overly made up with cosmetics I mean, was she wearing hot pants, was she flirtatious in any manner at all.
There are creeps that get turned on when they see bimbos like the ones I've described. If this mom falls into such a category then she did, indeed, bring on the rape she experienced. If she's a simple unpretentious mom then let the axe fall on the bastards neck. And on Marriott's as well. People, take a drive down Maine Street, and/or go to any shopping center, and open your eyes and take a good look at the parade of bimbos openly strutting their stuff. It's a wonder that there aren't many more incidents where the creeps (rapists) lose their cool. Anyway, 20 years is not enough time in the slammer. I'd have given him at least 40 years to play with his phantasies. As for Marriott, ask any chamber maid about the mess they frequently have to clean up after a patron checks out. Marriott knows very well what I'm referring to, and should heighten the measures that will offer their patrons optimum security. Mike

I think people are hating on Marriott because they are trying to defend themselves from a lawsuit that they had nothing to do with. How can you blame Marriott for "allowing a rape to happen" when they clearly didn't. Their response sounds cruel, but who sued whom? Did Marriott sue this woman? NO, she sued them. At a time when hotel's are struggling to even stay open this one gets sued because they didn't stop an act they didn't know was going to happen?!?! How do you "stop a suspicious acting man" when he is in a public parking garage? What do you say, "Excuse me, you are acting suspiciously, please leave!" What if he said, "My car is parked on the upper deck and I'm waiting for a locksmith to help me unlock it."? How could the hotel keep this event from happening? Makes no sense to sue the hotel, sue the rapist! And he gets 20 years?!? That SUCKS! He should have gotten the death sentence. But don't blame the hotel for defending themselves from a specious lawsuit.

I work at a Marriott and at a very safe location. I can believe some people are saying that they wont stay at another Marriott again. If you are smart enough to look into it, then you would see that they are a franchise. That is why Marriott int. is not in the case. Its the same thing if you are against Micheal Vick being signed with the Eagles then you wont watch another NFL game ever again instead of just boycotting the Eagles. People love to express their opinion when they barely have any of the story. Are people that ignorant that they think everything in the media is entirely true?

They are victims... get it? At worst she was guilty of not being aware enough of her surroundings. At worst the hotel was guilty of not acting on a possible 'suspicious' guy. The real blame for a crime belongs to the criminal who commited the act. Stop going after the corporation because they have money, stop blaming the mother because she was attacked. Blame the criminal who commited the crime. Have a judge do a little creative sentencing so this 'man' spends the rest of his life making up for the problems he and he alone created.

It scares me that people like Mike Harris exist. Women who want to look nice are trying to do just that, even if what they feel is attractive is not modest. We are not animals and I believe men have evolved, so let's give up that excuse once and for all. Unmodest women are not "asking" for it, nor do they "deserve" to be completely disregarded as a human being. If you are confused on how people "deserve" to be treated, Mike Harris, ask God.

It also scares me that people like Mike Harris exist. It doesn't matter if that woman was walking around naked. No one has the right to sexually assualt another person under any circumstances. period. It makes me sick that a raped woman's appearance and lifestyle are always so scrutinized. This is why many women who have been victims of rape never come forward. Mike Harris; you should embarrassed by your disgusting comments.

WOW. The comments by Mike Harris, a male of course (why is it always men who make these kind of comments), again shows that some men are pigs or just very ignorant. I don't care if a woman is NAKED in front of a man. It NEVER gives a man the right to FORCE her to have sex with him. It wouldn't be smart on her part, but she did not ask for it. No is NO.
This kind of thinking that a woman must be wanting money (because she sued) or was asking for it is almost as bad as doing the act itself and why people still do it or get away with it today. Some women fear this kind of response and either never say anything or recant their statements. If I got raped, heck yes I'd sue. I know people who have been raped and it really messes them up. They never called the police and rarely told people because they feared somehow it was their fault. And its guys like Mike above that make them think this. They think maybe they dressed wrong or did something that set him off. They start replaying events in their mind and analyzing everything.

Some people never recover from the emotional wreck it puts them in. And if that is the case, whose going to pay for psychological examinations and consultations? That stuff is not cheap. What if this woman's children are messed up for years too?

I am a business student and I can say a hotel that does not provide adequate or reasonable (the key word here) safety measures, it is bound to get sued and deserves to be. Why do you think malls and most hotels have security?
If a person gets hurt at a person's house, they are liable. Why should it be any different for a business? If businesses did not need to be held liable, I can assure you there would be a lot more incidents of violence.
